Terms and Conditions, Disclaimers, Privacy and End-user Agreement

This is an agreement between You (End-user) and MoodNote LLC (MoodNote). Please read it carefully. To use MEDpicker^® RX you must agree to these Terms. If you do not agree to the Terms, do not use MEDpicker^® RX.

Not A Medical Device

BY USING THIS SOFTWARE (“MEDPICKER^® RX”, ALSO REFERRED TO AS MEDPICKER^® RX, MEDpicker OR MEDPICKER RX) YOU UNDERSTAND AND AGREE THAT IT IS NOT A MEDICAL DEVICE. THE FINAL DECISION AS TO WHICH MEDICATION TO PRESCRIBE IS A MEDICAL DECISION MADE BY A PROPERLY TRAINED AND DULLY LICENSED MEDICAL PRACTITIONER. YOU UNDERSTAND AND AGREE THAT MEDPICKER^® IS NOT A SUBSTITUTE FOR THE PRESCRIBER AND IS INTENDED TO BE USED FOR EDUCATIONAL PURPOSES ONLY. YOU UNDERSTAND THAT MEDPICKER^® SOFTWARE MAY CONTAIN TYPOGRAPHICAL ERRORS, ERRORS IN CODING AND OTHER UNKNOWN ERRORS, WHICH MAY RESULT IN INCORRECT RESULTS. THE SCORING RANGES AND NORMATIVE VALUES PROVIDED ARE AVERAGES AND ESTIMATES, WHICH MAY NOT BE APPLICABLE TO EVERYONE. ONLY DIRECT, PERSONAL EVALUATION BY A HEALTH CARE PROFESSIONAL CAN PROVIDE YOU WITH AN ACCURATE ASSESSMENT AND DIAGNOSIS OF OR TREATMENT RECOMMENDATIONS.  YOU UNDERSTAND THAT YOU ARE RESPONSIBLE FOR DETERMINING THAT THE MEDPICKER® AND/OR MOODNOTE LLC SERVICES MEET YOUR NEEDS.

No Warranty

BY USING MEDPICKER^® OR ITS DERIVATIVES THE USER AGREES AND ACCEPTS THE SOFTWARE AS IS WITH NO WARRANTY, EXPRESS OR IMPLIED OR FITNESS OF USE. MOODNOTE LLC MAKES NO GUARANTEE ABOUT THE RELIABILITY, ACCURACY, OR TIMELINESS OF THE SERVICE OR THE RESULTS OBTAINED FROM THE SERVICE. MOODNOTE LLC PROVIDES THE SERVICE “AS-IS,” “WITH ALL FAULTS,” AND “AS AVAILABLE.” YOU BEAR THE RISK OF USING IT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOODNOTE LLC GIVES NO EXPRESS WARRANTIES, GUARANTEES, OR CONDITIONS. YOU MAY HAVE ADDITIONAL RIGHTS UNDER YOUR LOCAL LAWS THAT THIS AGREEMENT CANNOT CHANGE. TO THE EXTENT PERMITTED BY LAW, MOODNOTE LLC EXCLUDES ANY IMPLIED WARRANTIES OR CONDITIONS INCLUDING THOSE OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, WORKMANLIKE EFFORT, NON-INFRINGEMENT, AND SATISFACTORY QUALITY.

TERMS & CONDITIONS OF USE AND END-USER AGREEMENT

MEDpicker^® is educational software developed by MoodNote LLC with a goal to to illustrate drug-drug and drug-gene interactions, and facilitate prescriber and non-prescriber understanding of medication interactions with each other and with a person’s genome. By using this software you accept the Terms & Conditions of use. Please read them carefully. If you do not accept the Terms & Conditions, do not use this software.

Risks

There are risks associated with using this software.  Calculations performed by this software may result in errors, may be un-interpretable or incorrect. There is a small chance that your data may be intercepted by third parties, lost or damaged during the transmission through the internet. You should not change your health behaviors or prescribing decisions solely on the basis of the information obtained from MEDpicker^®. The MEDpicker^® interpretation of DNA and other  data is based on research published in peer-reviewed medical and scientific journals conducted by parties outside of the control by MoodNote LLC. We thoroughly review this research before applying it to interpret results of calculations performed by this software. However, not all research studies are accurate and they may not disclose all information. Future research may change today’s interpretation of tests and future research may show today’s research to be incomplete or inaccurate.

Privacy

MoodNote LLC does not sell or otherwise share or distribute any information that you provide to us during the registration process. In order for MEDpicker^® to work properly a user may be asked to login by using third party credentials. This process is separate from the MoodNote LLC website registration and information provided to the third parties is not store or otherwise collected by MoodNote. If you use your email address as your login information, MoodNote LLC may use it to contact you to inform about product updates and conduct customer satisfaction surveys. You will have an option to opt out and not be contacted by MoodNote.

All web site and/or application design, texts, images, graphics, other content, and any part or arrangements thereof, as well as all proprietary software or other features used on the web site and/or application are the property of MoodNote LLC or are used under a license. Any use of materials on this application including their reproduction, modification, distribution, or republication without the prior written consent of MoodNote LLC is strictly prohibited. The original works incorporated into developing MEDpicker® are in public domain and where appropriate we provide citations to such works acknowledging the intellectual contribution of their authors, publishers or academic institutions of origin. However, if you are a valid copyright holder for a work used in MEDpicker® app, and you believe that such use violates your copyright, please send us a DMCA takedown notice via e-mail to moodnoteservice(at)gmail.com.

Term and Termination

This Agreement does not have a preset termination date and may be cancelled by either party at any time with or without notice. Upon termination all your genetic and any other information will be deleted, and will not be retrievable.

Google Analytics Disclaimer

This app/website uses Google Analytics to help analyze how users use the app/website. The tool uses “cookies,” which are text files placed on your computer or mobile device, to collect standard Internet log information and visitor behavior information in an anonymous form. The information generated by the cookie about your use of the website (including your IP address) is transmitted to Google. This information is then used to evaluate visitors’ use of this website and to compile statistical reports on website activity. Moodnote LLC will never (and will not allow any third party to) use the statistical analytics tool to track or to collect any Personally Identifiable Information of visitors to our app/website. Google will not associate your IP address with any other data held by Google. Neither Moodnote nor Google will link, or seek to link, an IP address with the identity of a computer user. You may refuse the use of cookies by selecting the appropriate settings on your browser (if available), however please note that if you do this you may not be able to use the full functionality of this app/website. By using this app/website, you consent to the processing of data about you by Google in the manner and for the purposes set out above.
